to TeamStake.com (“TeamStake,” “we,” “us,”
or “our”).
These Terms of
Service (“Terms”) govern your access to and use of our website, mobile services, and any
associated tools or features (collectively, the “Services”).
By accessing or using the Services, you acknowledge
that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree, you must not use the
Services.
1. Eligibility
- You must be at least 18 years old (or the age of majority
in your jurisdiction) to use TeamStake.
- By using the Services, you represent and warrant that:
- Your participation in fantasy sports leagues and related activities
through TeamStake is legal in your jurisdiction.
- All information you provide during registration and thereafter
is accurate, current, and complete.
2. Nature of the Services
- Payment Platform: TeamStake is not a fantasy
sports league operator. We provide software and payment tools to enable league commissioners and
participants to collect, hold, and distribute entry fees and payouts.
- No Gambling: TeamStake is not a sportsbook,
casino, or wagering platform. All activities on the platform must be structured as skill-based
fantasy contests and comply with all applicable laws.
- Commissioner-Controlled Leagues: Each fantasy league is
organized and managed by its commissioner(s), who are solely responsible for the league’s
rules, scoring, decisions, and resolution of disputes.
3. User Accounts
- You must create an account to use most features of TeamStake.
- You are responsible for maintaining the confidentiality of
your login credentials and for all activity conducted through your account.
- We reserve the right to suspend or close accounts that
violate these Terms, applicable law, or that pose a risk to the integrity or security of the platform.
4. Deposits, Withdrawals, Fees, and
Refunds
- Deposits: You may fund your TeamStake account using
supported payment methods. All deposits are final unless otherwise required by law.
- Withdrawals: Withdrawal requests may require identity
verification (KYC). We may impose limits, delays, or additional steps to comply with laws,
prevent fraud, or ensure platform integrity.
- Processing / Convenience Fees: We may charge a processing
or service fee for certain payment methods or transactions. All such fees will be clearly
displayed before you confirm your transaction.
- Chargebacks / Reversals: If a payment is reversed or
disputed (e.g., via chargeback), TeamStake may freeze or reverse funds related to the
league and deduct any associated costs, fees, or penalties from the responsible user’s
account or from the league pool, as appropriate.
- Refunds:
- Refunds requested before the league’s published payment
deadline may be honored (subject to applicable processing limits and timing).
- Refunds requested after the league’s payment
deadline generally require approval by the commissioner (and, in some cases,
by TeamStake) and are not guaranteed.
- Refunds will be processed back to the original payment method
whenever possible; otherwise, alternative arrangements will be made at our discretion.
5. Dormant Accounts
- An account with no user-initiated activity (including, but not limited to,
deposits, withdrawals, staking transactions, or league participation) for eighteen (18) consecutive months
will be classified as dormant.
- Once classified as dormant:
- The entire remaining balance may be moved from the active cashier to
a secure custodial account to protect user funds and prevent unauthorized access. To reactivate a
dormant account, please contact our Live Support team via TeamStake.com for assistance.
- A custodial and maintenance fee equal to five percent (5%) of the
dormant balance per month will be assessed on accounts that remain dormant beyond the eighteen-month
period.
- Upon reactivation and completion of any required identity
verification, the remaining balance — after deduction of any accrued custodial and maintenance fees — will
be promptly restored to the user’s cashier for immediate use or withdrawal.
- These fees are intended to cover the reasonable costs of secure
custody, compliance obligations, fraud prevention, and ongoing platform maintenance.
- To the extent any portion of a dormant balance is deemed abandoned or
unclaimed under applicable state law, it will be handled in accordance with the reporting and
remittance requirements of the relevant jurisdiction. No further fees will be assessed after the
balance has been remitted to the appropriate authority.
6. Commissioner Responsibilities
- League Setup & Rules: Commissioners are responsible
for clearly stating the league’s rules, scoring system, payment deadlines, and payout structures before
accepting participants’ payments.
- Payout Rule: Commissioners must select a payout rule
(e.g., commissioner-controlled, majority-vote, or unanimous-vote). Once participants have joined or made
payments, the payout rule is fixed and may not be changed without the consent of all affected
participants.
- Voting & Deadlines: If the payout rule involves league
member voting, commissioners must set clear deadlines. Non-responses may be treated as abstentions or as
otherwise defined in the league rules.
- Funds Management: All league funds collected via TeamStake
are pooled and managed under the commissioner’s direction, consistent with these Terms
and the league’s stated rules.
- Dispute Resolution & VIP Management Fee: TeamStake
does not mediate disputes between commissioners and participants; all such matters must be resolved within
the league. However, if a commissioner elects to include a VIP Management Fee (up
to 25% of total league entry fees) to help cover league expenses, that fee also includes
access to expedited payouts and TeamStake-supported arbitration services for any
league-related disputes. The VIP Management Fee, if applied, is shared equally (50/50)
between the commissioner and TeamStake.
7. User Conduct
You agree not to:
- Violate any applicable laws or regulations.
- Use TeamStake for illegal gambling or prohibited
activities.
- Provide false information, impersonate others, or attempt to evade
eligibility, KYC, or security measures.
- Interfere with the operation or security of the Services (e.g., by hacking
or introducing malware).
- Engage in abusive, harassing, or fraudulent behavior toward other users or
TeamStake staff.
8. Compliance,
Verification & Anti-Money Laundering (AML)
- We may require you to provide identity documents, tax forms, and
other information to comply with KYC and AML laws.
- We reserve the right to block or reverse transactions, freeze
funds, or report suspicious activity to regulatory authorities or law enforcement.
- Failure to provide requested information may result in restricted access,
delayed withdrawals, or account closure.
9. Risk Disclosure
- Participation in fantasy sports leagues involves financial
risk. You acknowledge and accept these risks.
- TeamStake is not responsible for league rules, scoring decisions,
commissioner conduct, or competitive outcomes, and we make no guarantees regarding
winnings or payouts.
10. Intellectual Property
- All content, trademarks, logos, and software on the Services are owned by
or licensed to TeamStake and are protected under applicable intellectual property laws.
- You may not copy, reproduce, distribute, or otherwise use any of our
intellectual property without our prior written consent.
11. Disclaimers
- The Services are provided on an “as is” and “as
available” basis without warranties of any kind, whether express or implied.
- We do not guarantee uninterrupted or error-free operation, and we disclaim
liability for any loss of data, malfunction, or service outage.
- TeamStake is not responsible for any act or omission of commissioners,
league participants, or third-party service providers.
12. Limitation of Liability
To the fullest extent permitted by law:
- TeamStake’s total liability to you arising from or related to your use of
the Services will not exceed the amount of fees you paid to TeamStake in the six (6) months
preceding the event giving rise to the claim.
- We will not be liable for any indirect, incidental, consequential,
special, or punitive damages, including but not limited to lost winnings, lost data, or
reputational harm.
13. Indemnification
You agree to indemnify, defend, and hold
harmless TeamStake, its affiliates, officers, employees, and agents from any claims,
damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related
to:
- Your use or misuse of the Services.
- Your breach of these Terms.
- Your violation of applicable laws or any third-party rights.
14. Termination
- We may suspend, restrict, or terminate your account at any
time if we believe you have violated these Terms or applicable law, or if necessary for platform security,
compliance, or risk management.
- Upon termination, we may retain records as required by law and distribute
remaining funds in accordance with these Terms and applicable regulations.
15. Governing Law & Dispute
Resolution
- These Terms are governed by the laws of Delaware, USA,
without regard to its conflict-of-law principles.
- Any dispute, claim, or controversy arising out of or relating to these
Terms or the Services will be resolved by binding arbitration in Maricopa County,
Arizona, USA, administered under the applicable arbitration rules in effect at the time.
- By using the Services, you waive any right to participate in class
actions or jury trials, to the maximum extent permitted by law.
- Where prohibited by applicable law, users may retain the right to bring
certain claims in small-claims court.
16. Modifications
We may update these Terms at any time. The updated
Terms will be posted on TeamStake.com with a new “Effective Date.”
Continued use of the Services after the effective
date constitutes your acceptance of the revised Terms.
